Not sure what else to add. I already sent the link to the Secret Barrel site and did my best to point out that, hey, Upland sets the prices on these things, so it's not like they need worry about the distributor jacking up the case price.
 
That's not what Upland intends to do. The whole marketing pitch in the emails was that you didn't have to worry about applying for the lotteries, like everybody else who wanted to purchase the lambics.
It was posted earlier that there were going to be a couple of member only beers included in the membership.
 
I guess since I am the only one dumb enough I could post the members email received today if that is of interest?

So nothing seems set in stone really.....yet.
 
From what I'm hearing from Upland it sounds like they have sold "about" 70 memberships.

I actually thought it would be more. I also wonder how many were refunded. I think its insane to spend $450 on 8 beers and 2 TBD events but to each his own. Id rather spend $450 drowning myself in Lift Off cans!

if this is the kind of opinion that Upland has received from the state alcohol authority I can't blame them for not including payment of the bottles in their membership.

I agree completely, why risk it?

i can blame upland, however, for still charging i price that would be appropriate if the bottles were included ;)

I would like to know how this applies to things like "Mug Club" which are all over indiana (including Upland), seems like that more clearly violates IC 7.1-5-5-7 then a pre-sale would... and besides, the law states something to the effect of "at the same time", ie: if the price changes later, as long as the "discount" bottles don't change hands after any "full price" bottles do, you are still ok?

I am not a lawyer, just bitter at Upland ;)
 
As Excise interprets this I would also think this law would apply to Kahn's selling Bordeaux futures but there seems to be no issues with that. Or does Indiana state law distinguish a difference between wine, spirits, beer, etc?

And that has been one of my points before. When we pre-order them from the producers we are offered lower pricing, and well before they are physically available. When/if the distributors decide to bring them in all pricing increases. Wine laws are different altogether though. Stores can have wines directly shipped. It's how certain franchises have certain exclusive wines.
 
I genuinely feel the whole world is laughing at me here. This is almost EXACTLY like the time I made my video.

Eh, there are worse ways to spend $250. I mean, you could drive a 2 million dollar car into a lake.



If you like Upland's sours and don't mind the price, then why not join? Your posts this whole time have been hilarious though...
 
OHEY! Just got a voicemail from Scott Bedwell, Industry Liason for the IN Excise Police. I just missed him leaving the office, but I'll touch base with him on Monday to verify if Upland's legal assertions are correct. I'll be sure to draw the comparison to wine futures, which are definitely legal in the state of IN.

It's amazing that you seem to be putting more effort into this than Upland did.

It's not amazing to me at all. It took me like 15 minutes to find out the CA breweries were full of **** when it came to growler laws, 15 minutes that apparently none of them took. Many breweries, including Alpine, still aren't in compliance with the law. It's baffling, but at this point utterly expected, that breweries seem so disinclined to actually know the laws they operate under.
