Actually it's quite a bit different IMO. The convenience store is not billing you to give you back your own property. The guy is not buying a twinkie where he can choose to take his business to some place that will take his pennies. To some extent towing companies are acting as a billing proxy for the govt so they don't have to pay to have you towed and recoup from you. Towing companies make collection agencies shake their head in disgust so I feel no real sympathy here.

You are wrong.If the company says they accept "cash" then they leaglly have to except any form of it.

A private towing company is not a government agency. They are a private company. It was never made clear whether this was a tow from a public or private location; it could have been either. Therefore, this "proxy" nonsense is unjustified at best, but the bottom line is that the mouth-breathing moron in the video is dealing with a debt he incurred with a private company.

The ********* clearly doesn't know what "legal tender" means, and spouting "they have to accept it" is clearly wrong. The cops were wrong as well, which doesn't surprise me, since they wouldn't know anything about this either.

It doesn't matter whether you like towing companies or not, nor does it matter if you feel any sympathy towards someone or something. The law is the law, and it was on the side of the towing company.

It really is that simple, yet so may here refuse to accept it.

So are you saying that if I get my car towed because I parked illegally then I can have the towing company prosecuted for theft? If they are just a private company with no special privileges and they took my car without my permission that means they stole it.

Surely there are laws that they must follow, and believe me, the owner of the company knows more about these particular laws than most lawyers. I also believe that they have to be licensed by the state to run their business.

This is a PRIVATE COMPANY towing a car from PRIVATE PROPERTY, 100% legally. No government agency is involved.

Do you have any experience with tow truck companies at all? From what you are saying it sure sounds like you really do not. I work for a company that deals with hundreds of tow truck companies. I am VERY familiar with how they work and what they have to do.

You are assuming in this case that it was a tow from a public place; I don't know why you are assuming that to be the case. And even if there is a government contract, the COMPANY is still private.

You're right I do not know. But I also said before that I did not know and that everything I was saying was being based on that.

There really is no point in even going any further with this because obviously you don't understand that not everything is black and white, that there is some gray area.

Plus, yes cops are not always correct but in order for 3 different cops to agree on it, especially when they looked up the actual statute, would be pretty rare.

Bingo! A company can refuse types of payments like 50$ and 100s but this need's to be posted prior to any contract like ordering a sandwich. The tow company unless posted has to accept payment of any legal US tender unless otherwise posted if they accept cash.

I do not accept cash in my business and I have that right as it is posted on the entrance and in the office.

First off there was no reason for the cops to be there in the first place. This was a civil matter not criminal. It had to do with contract law. The cops should have told the guy to call a lawyer.

And you actually think the cops looked up the statute? I'd place a bet they just told the lady to accept the pennies so they could get the **** out of there.

The law doesn't pick a side. The law is always open to interpretation and in this case the guy won (at least the first battle but I doubt the towing company went anywhere with it legally.) The cops agreed and it is really that simple until someone escalates it legally. Right <> legal. obvious <> legal. That's why we have so many lawyers.

I didn't say it was right because I don't like towing companies - I just said I feel no sympathy for them. That I don't like them IS what makes it funny I suppose... Anyway, time for a beer. Cheers!
