Redbull suing local brewery

I was in a trademark dispute once over the name of my corp. being similar to a company that was 100+ miles away and in a different line of work. This dispute was not started by the other business but with the trademark office. Fortunately for me it was another small business and it was as simple calling the owner and have him write a letter to the filing office. Should be this simple for all disputes like this, but then lawyers would have to find real work.

Nah. They are just having fun. The courts won't look at this stuff anyway.

Frankly neither of them are going to "win" and the only people making money are the lawyers.

Red Bull will discover all the negative things being said about them and settle with Ox having to promise not to make energy drinks or use a logo similar to Red Bull's.

Lame that it has to go this far before that happens, but there are people out there who get paid to watch out for potential trademark violations and they want to get paid too.

I agree completely... but doing stuff like this is just poking the bear (bull) in my opinion. Do it after a settlement and keep it quiet if you have to, but until then... why? I don't see any possible benefit of it.

This could drain Ox financially. Red Bull will go on to making their drinks and having college kids wander around in skimpy clothing to give out free cans all while Red Bull rolls in the cash. They won't feel the burn from this one bit. It is sad, but likely true. I hope there's a lawyer who can help Ox pro bono so they can survive and continue to make craft beer, the hard way.

This is what bothers me. RedBull knows full well they have the money to play this game until Ox runs out of money.
I wish Ox the best of luck in this and I hope I'm wrong about the outcome. Piss on RedBull and Monster for these kind of tactics. I don't buy their products and never will.

local businesses have been very supportive

the Buffalo Wing Factory in Sterling has stopped selling Red Bull and they have been serving Black Ox since it's been available.

not sure about the other locations

No, this is the only way for small businesses to compete against multinational corporations. Transfer the argument from the expensive, corporate-favoring courtroom to the court of public opinion. Corporations thrive on lawyers and secrecy and brute force, and bad PR is the best lever to use against them.

Making tshirts with the Red Bull logo while arguing that your logo is nothing like theirs would be asinine. That being said, they didn't make the shirts, some of their customers did, so I stand corrected.

Just to correct some misconceptions, Red Bull is not 'sueing' Old Ox. They are blocking Old Ox's request for their trademark. It still requires various legal responses from Old Ox, which wastes their time and money, but it is not a suit. Red Bull claims that this is just normal business. That may be true for a large company with dedicated legal departments, but is definately not true for the small start up. Red Bull has no legal blow back if they lose. Personally, I think that if we are to stop this kind of harassment of small business by deep pocket corporations, they have to have some skin in the game. It would be great if Red Bull eventually loses, that they would have to change their name.

That was until the lawyers at Wyndham Hotels and resorts, located in Australia, decided to start a trademark war. The winery changed its name because it couldn't affort to fight the frivolous action.
