This is a good point. Although I don't think (Disclaimer:not a lawyer, didn't even check Wikipedia) that simply asking someone to leave gives the owner license to use any and all force to remove the patron. I would assume it would still be assault on the owner's part if he asked him to leave and then 30 seconds later came over and cock-punched the guy.

I've seen several times where security guards kicked someone out of a casino or club. Usually the security guards gently press their hands into the peoples' backs in the direction of the nearest exit. No one is likely to get in legal trouble for doing that. They'd definitely better be careful any time that they are doing that, because if they cause someone to trip down stairs or something like that and someone gets injured, then the business could be in some legal trouble.

This was an incredibly entertaining read! :) I don't think you ever fessed up to whether or not you DID seat yourself. Surely you didn't know they were saving it for a party, but if that was the case, why wouldn't you have been more understanding?? It sounds like they told you they were reserving the table for a party and you argued with them...not that it justifies his actions, but it makes sense why they would have been a little irritated with your table. Lets not breeze over the details here...why did you feel that they were treating you unfairly BEFORE the owner came into play?

I heard that the table was reserved for Lady Gaga and her entourage who were attempting to set up a theater in the round type nude performance of Equus at Freshcraft...that certainly didn't help matters...

I was there this weekend. Quite possible saw this. If it's the altercation we witnessed, then Hernando's account is mostly true, however somewhat watered down. From where we sat, it looked like the owner's account was closer to the truth.

Everyone was very nice to us, no one appeared drunk and the place was busy as hell. They were just trying to handle a GABF rush.

For all those saying they wouldn't patronize the place, good. More room for those of us who like it there.
