Should I send my heating element back?

I received two heating elements in the mail today from TheElectricBrewery.com, both are the 5500W ULWD ripple. On one of them, where the element wraps around and comes back toward the base, it touches the other side of the element (see photo below). Is this bad? Should I have them send me another one? I'm worried that with how hot they get, it could be problematic, but I'm new at this.

It doesn't matter if it's touching or not. If you're weird and don't like it touching, the spread it apart.
 
Also as said, it makes no difference.

Many people in addition to this have the element touching their pot, again..it makes no difference to performance or safety.
 
+1 to this not making a difference.

I pulled mine in the boil kettle apart slightly to make getting a sponge through it easier (for cleaning purposes):

(You can't tell from the pic, but I've pulled it apart vertically as well).

Do be careful bending it. Don't put all the force in one spot.
