Put up no trespassing signs and then press charges when they are on the property they will stop taking the cherries. get video of you asking them to stay off the property and stop taking your produce. Give the video to the officer taking the report. Be ready to go to court.

IANAL but as I understand it is if it's been permitted before they can make claims that it was allowed and therefore expectable. It's f'n stupid though. I have a 60ft tall pine tree that I can't easily remove from my yard because of it's proximity to the utilities that feed my neighborhood hub'd in my yard (they put them in before I got there). As far as I'm concerned being used for a hub for such things should at least get me a decent deal but I couldn't even renegotiate my cable last time around so I told them to come get the box. So help me if I ever find an attorney brave enough to fight them in court I'm going to call them to come get the tree or tie it to a chain and yank it down.

The reason they can have the pole there in your backyard is there is an easement and it is guarenteed even upon the sale of the property. Part of the contract, if there is no easement then it is your land to do as you wish. Signs and fences can keep people off the land even if use was was granted in the past. You have the right to deny accss.

You might not have the right to deny access, check out the laws regarding adverse possession in your state. That's why some some large office buildings with a plaza in front will block it off for "maintenance" for a day each year. They retain their property rights that way.

I just got a new batch of neighbors the other day. I can't wait to brew and have them walk out. I would be very shocked if I walked out and they where brewing.

The first time I brewed at my new house, I had a neighbor come out to ask what I was doing. He later came out and offered me some moonshine. He didn't make it, but it was still cool, none the less.
