I got the same response from Chelsea except it said that they were not suing Old Ox as well. What a bunch of crap! I didnt even mention in my first letter that they were suing them. I of course sent a worse letter back after getting this one last night and after a few drinks. :D

Well, if they only filed a Notice of Opposition, then they're not suing, yet. I could be wrong though, for sure. Right now they're simply making it known that they oppose the Ox branding and they believe, albeit ridiculously, that somehow people will have trouble distinguishing between the two brands. I'm not trying to defend Red Bull, their tactics are absolutely ****ed up, and the responses from Red Bull to concerned consumers is nothing more than a middle finger to all, but I don't think there is a suit filed, yet. I haven't searched. Regardless, they're costing Ox a lot of money that they most likely do not have. A brewery that has been opened less than a year is not likely to be running around in the black or if they are, they're probably not too far into the black to be able to handle this without help.

You are right, they havent filed any suit yet. I bet they have a lot of guys in suits though. :D
 
Dracula: Untold was disappointing. Fun.. but too pretty. Also couldn't stop thinking about the local brown ale I tried last night that tasted so toasty, chocolaty and of rich coffee. It is not even a style I would normally reach for, but if I could make anything remotely close to that I would be a very, very happy man.

Too much energy from a few extremely solid nights of sleep.

Gotta love the no info form letters. I am sure that was drafted up by the legal department to be as vague as it is so that they dont hurt their 'case' as it is flimsy enough as it is. It is good that so many are expressing their concern in how stupid this is as maybe it will show them how ridiculous they are being.

Since I dont use it and frankly refuse to, I wonder how many people have been blowing up their twitter feeds with twits about how stupid it is.

Yeah twitter is ridiculous about this. They probably just don't even look at it now.

I rented two movies last night that were really good. Gone Girl, which I didn't read the book nor did I see a lot of discussion about it spoiling the plot for me after it was out in theaters. That was a really great movie. And the Judge, which was a really great movie as well. Neither of them are action-packed or anything, but they're just written pretty well and kept me interested.

More coffee.
 
I rented two movies last night that were really good. Gone Girl, which I didn't read the book nor did I see a lot of discussion about it spoiling the plot for me after it was out in theaters. She wanted me to watch Gone Girl with her, but I feel like I've seen it already due to my boss absolutely beating us over the head about the book at work. I'm big into the history of Dracula and was pretty excited for this new interpretation but it was just not gritty and raw enough.

I got talked into watching Lucy last week. It was entertaining, expected more as well but it looked gorgeous on the tv we bought ourselves for xmas. Two movies is a record for me in a year and I already know... I'm getting blitzed out of my mind and watching Dumb and Dumber next week :D

it all started with Old Ox's original logo. Red Bull complained about it, so Old Ox changed it to their current one. Understandable, perfectly reasonable and Old Ox complied before they opened. When changing the logo did not constitute a large financial burden.

then Red Bull came back and demanded Old Ox change their name, not use the color red and to not make any soft drinks.

Old Ox would only promise not to produce energy drinks. Red Bull responded with the suit.

Old Ox has been more than reasonable, but Red Bull wants more than just a "fair agreement"

I like their new logo better, this one is harder to read. I'm really hoping Ox makes it out of this as unscathed as possible so that all of this publicity helps them. My family and friends in the area are now aware of them and excited to visit and show their support and I'll absolutely be keeping an eye open for their product.

As far as I know, there is no suit currently going on, just demands and threats of legal action. And you are right, the reason red bull hasnt let up is because Old Ox will not agree to not produce soft drinks. They want to be able to serve home made root beer to patrons that do not drink or are driving.

Not quite, from what I have read. It sounds like Old Ox has filed with the US Patent and Trademark Office to register its logo and name. While Red Bull has not filed a lawsuit, they have filed an official objection to the granting of a registered trademark to Old Ox. I am sure it is expensive to fight that objection. I do not know enough about procedures within the USPTO, but I hope there is a procedure by which to cause the objecting party to pay the legal fees if the objection is deemed to be frivolous. There is a procedure for this in most court systems (sanctions) but it is not granted very often.
 
I think it's all bs. Everyone knows breweries, like restaurants, have a fairly high rate of failure. They a HUGE financial buisness risks. The fact is that a company as high profile as red bull shouldn't be concerned with such a small small business who in all logic won't effect one but of sales for multi billion dollar red bullsh!t!!! It's a HUGE financial burden for a company with ANY kind of legal battle. So there's no suit, so red bull is acting within it's legal right, this doesn't make any of this ethically moral. Red bull is basically telling me they're content with being jerks because it's within they're legal right. It's a slap in the face to business ethics.
 
Drinking cold coffee...not iced, just got cold and there's not enough to bother microwaving.

Red Bull sucks. It doesn't even taste good. And there are lots of warnings out there about energy drinks, in general, regarding health risks. My son-in-law used to drink 2 or 3 per day and started having chest pains. His doctor told him to eliminate them completely. I think he still sneaks one in every couple of days. It worries me. You twenty and thirty-somethings out there need to understand that energy drinks are not just a simple substitute for coffee+soda. I'm not a big government regulation kind of guy, but the FDA needs to be all over that sh!t. Red Ox Root Beer...or beer for that matter, sounds and would most likely taste MUCH better than Red Bull.
 
A 3.5 foot deathcicle fell from the second floor roof last night and punched a hole in my porch.

That's hilarious, yet sucks at the same time. Over in your neck of the woods right now. Dropped off a client for an appointment and picked up the carburetor part I broke last night. I'm NOT gonna break this part (again) and if I do, I'm done screwing around with the damn snowblower.

Last sip of cold coffee before going back to the office for more coffee.

Haha I was over at the psych center next to buff state. I never make it up to the island unless it's summrr and I'm taking the kids to fantasy island.
I was gonna brew tonight but now I think it'll be another night of piecing back together the old beast.
