Landlord issues.... Short Sale on apt.

Clearly she is in way over her head and she's just scraping by trying to find any way to get out of it. My husband read the addendum when at work and just replied back to her "lol there is no way in hell I would ever sign that"

My main problem
a) We are not being compensated nearly enough. Well actually I'm not sure because nothing is specified! "My assistance" could mean she holds the door open while I carry my crap out. It doesn't even say monetary assistance.
b) she should be paying a penalty for breaking the lease. We can't break the lease the way it stands. Almost all my other leases included a clause for 1-2 months penalty and continuing to pay until it is rented. So I believe a penalty is fair.
c) she would have to give more then 30 days notice. Once again, 60 days notice is typical of every lease I have signed previously.
c) there a ton of "what-if" situations that are not addressed.

What if it closes on the 16th of the month or some equally random day?
What if the closing is delayed or doesn't go through but you already gave us notice? According to this, I would have to stay because the house would not go through closing regardless of if I found housing elsewhere.


She keeps saying every email that there's a better deal for us to rent somewhere else. I say show it to me. There is nothing within the city that is comparable to where we live and in the comparable condition, size and price range. I know we could move to the suburbs and save some cash and get a bigger place but I'm not willing to do that yet. We've never gotten the chance to live in the city so when my husband got this new job I promised we would at least for a few years. We just spent 5 years of torture in the burbs we can't go back so soon.
 
There are deals out there that are close to downtown (8 minutes by lightrail for us) but not likely in downtown. We looked into it briefly (ball park area) and I think a few others and it was all over 2k/month plus parking. It is true that in Denver the houses are older, but it is a tough renters market here in Denver. I think I read that there is 4% vacancy rate. I would love it if we had a garage for storage and brew space but we do not. However we have a really good landlord that fixes things that break (ie a frozen burst pipe @ 10pm last winter). So between SWMBO's art projects, my PC's and Brewing stuff , so we require a fair amount of room. It is still not ideal but it works.

Yeah those places are pretty comparable to where we are now. Except they cost a little more and are 6 to 7 blocks farther away. I mean on the surface it seems like we are paying a lot for one bedroom. But its 1000sqft with garage parking and extra storage and walking distance to where we drink.

We are in five points now and enjoy being walking distance to the main areas and thought this was the best compromise as its about 1 mile to the main streets in each direction. With our hobbies of brewing and guitar/music finding a place is just so difficult. Apartments that are the same sqft or bedrooms generally mean nothing to us its more how the space is laid out. If I walk through and can't figure out where a home studio, fermentation chamber, and keezer can fit then its no deal. For the most part that cancels out a lot of areas and drives up the price.

The best thing to do is to not just say no I'm not signing that and do nothing else, but to actually tell her what you want. Rewrite the addendum to something you would sign (plus some nice to haves that you can let her "negotiate" out and feel like she's winning;)). That way you are progressing towards a final decision and not just back to square #1.

Tell her what compensation you want and get her signed agreement on it,
Tell her what lease termination terms you want, i.e. the lease terminates on the first on the month following settlement
Tell her/make it that as soon as she gives notice the addendum is in force and you will be moving out on X date and she will do what she has agreed to do irrespective if the future buyer pulls out
