Auto-syphon check valve problem

The little valve thing in the bottom of the device opens fine when pulling liquid into the tube. Problem is when you push down the inner tube to start the syphon the valve stays open allowing all the fluid to push back out of the big tube thus, no syphon.

Anyone else have this issue and a possible fix? I could take the thing out and bend the legs but don't want to risk damaging the device.
