Anyone drinking well made craft beer would have no trouble distinguishing it from the absolutely sh*tty taste of Red Bull. Maybe Red Bull should consider a name change to Red BullCrap!
 
Letter from the owner of Old Ox to Red Bull

not only does Old Ox make tasty beer (had a couple pints this weekend), but Chris is most kind to let our homebrew club meet there and let us try his brews before released to the public.

Hey Red Bull –

You seem pretty cool. You sponsor snowboarders, adventure racers, rock climbers and motocross bikers. You launch people into space so that they can skydive back down to earth. That’s all really darn cool. For all I know, you’re reading this while strapping yourself into a Formula One racecar that is about to be lit on fire and jumped over a large chasm of some sort. How cool would that be? Feel free to give it a try.

Here’s the thing, though. You are being extremely uncool to us at Old Ox Brewery. We are a small startup brewery in Ashburn, Virginia. We’re family-run, we love beer, and we love our community. For reasons that we cannot understand, you have attempted to strong arm us into changing our identity for the last 10 months because you believe folks might mistake Old Ox beer for Red Bull energy drinks. We respectfully disagree. The only similarity between our two products is that they are both liquids. You make non-alcoholic (but very extreme) energy drinks. We make delicious (but laid-back) beer. Our consumers are looking for two distinctly different experiences from our respective products.

Basically you are holding us hostage with a list of demands that, if agreed to, would severely limit our ability to use our brand. Demands like, never use the color red, silver or blue; never use red with any bovine term or image; and never produce soft drinks. Do you own the color red? What about fuchsia, scarlet, crimson, or mauve? Are you planting your flag in the color wheel and claiming those shades for Red Bull? Do you claim exclusive rights to all things bovine? Do you plan to herd all heifers, cows, yaks, buffalo, bison, and steer into your intellectual property corral, too?

When we refused to succumb to your demands, you responded by filing a formal opposition to not just our trademark but to the very name Old Ox Brewery. Way to step on our American dream. You say you are protecting your intellectual property rights, but your claim, in our opinion, is Red Bulls**t.

We can only interpret your actions as one thing—bullying. You are a big Red Bully. Just like that mean kid from grade school pushing everyone down on the playground and giving us post-gym class wedgies. You are giving us one hell of a corporate wedgie. We don’t appreciate it and we sure as hell don’t deserve it.

Is this really what you’re about? Are you a bully? Your extensive marketing campaigns (your glitzy advertising, your sponsored sports events, your death defying stunt shows, etc.) certainly don’t project that image. Take a hard look at your “case.” Can you honestly look at our brand and say, “this is a threat to my image?” We don’t think you can. Given that, we repeat our offer: We agree NEVER to produce energy drinks. In exchange, we are asking for one simple thing: Leave us alone. Drop this trademark dispute. The only people benefiting are the lawyers.

Red Bull is simply being a corporate bully. Who in their right minds would connect Red Bull and Old Ox? The names have nothing in common except that they are both bovines. Maybe the Durham Bulls minor league baseball team should sue Red Bull for trademark infringement. It would make as much sense!
 
When I was growing up, Red Bull referred to Schlitz Malt Liquor

For the record.... Monster is suing two breweries in Virginia at the moment as well.

Three Notch'd Brewing because their logo looks SOOO much like the Monster "M"

It is sad that large corporations are going after the little guys but sadder when you look at Red Bull and Ox. Again, their main argument is that an Ox and a Bull are both bovine. That is cute. Nike should sue makers of socks because they both go on the feet.

Why stop there, Red Bull? Subfamily Bovinae includes Longhorn beer from Pyramid, Longhorn Steakhouse, Milwaukee's Water Buffalo Beer, Buffalo Wild Wings, the Buffalo Bills, etc. Better go after Moose Drool just to be sure.

Except its not the parent company thats involved. Its the American importer/distributor that owns the rights to the name here.
 
Yeah I saw that but didn't want to do the research to see if it was American owned or not and it is still red Bull company that is suing still means that a big chunk of the money is leaving the country. If you have ever read any other of my random spewing on this forum you know that's one of my peeves.
Just another example of big money kicking the guy with only change in his pocket.
 
This could drain Ox financially. Red Bull will go on to making their drinks and having college kids wander around in skimpy clothing to give out free cans all while Red Bull rolls in the cash. They won't feel the burn from this one bit. It is sad, but likely true. I hope there's a lawyer who can help Ox pro bono so they can survive and continue to make craft beer, the hard way.
 
This all just showcases the need for a massive amount of reform in copyright law.

Either that, or I'm going to trademark all the vowels and become a multi-gajillionaire.
 
There is a US Air Force squadron that goes by the name Red Bulls. Let's see them go after them.....

Seems your always there also. Although it doesn't make sense for a subsidiary of the company to sue instead of the actual headquarters of the company..... research time.....
As I thought the brewery is being sued by redbull gmbh an Austrian company by us lawyers, not by red Bull north American inc.
I don't in general have a problem with large companies as long as they can manage to conduct their business with out stomping the life out of every little guy for thing like are occurring in this lawsuit, for example. Red Bull also filed with the trademark office on the 2nd about some one wanting to call themselves Vitamin Red. How is this name going to be confused with Red Bull?
