Hi, i have an element in my kettle positioned like this image.

i am wondering if there is any problem positioning the element like this image.

I remember reading somewhere that it is best to have it vertical like the 1st image. but in my mind i don't see why it would make a difference at all in terms of heating water.

i am having clearance issues with my stainless basket i just bought and rotating the element should fix the issue.

I don’t think it matters which way the heating element is rotated.
 
I don't think it matters a ton, but it might be slightly better to have it facing like the first image so that the liquid isn't hitting the element twice as it rises. But that might just be nitpicky and it probably doesn't matter too much.

Except that it would "hit the element twice as it rises" either way since there are four straight segments on the element, you just can't see two of them in the first photo.

Location of the temp sensor relative to the element and recirc pick up (if recirc is in play) is more important than the orientation of the element. You want the temp probe, used to control the element power, as close to the element as possible, so that you prevent overheating, and possible scorching of, the wort because of a time lag between the element heating up and the temp probe sensing the heat up.

Lol, exactly. But when these are screwed into water heaters, does anyone ever even see the orientation?
