Does the regulator on the CO2 tank need to be above the top of the cornie? I'm guessing the answer is that it would be safer to do so, but not necessary.

The CO2 tank should be vertical and incorporate a good regulator and check valve, that's about all that matters. If you're getting beer blowing back into the gas lines, it will defy gravity and get to your regulator if you don't have a check valve installed.
