Its a kingsnake/milksnake not sure which, and they are usually well tempered, so feel free to pick it up
There's lots of cool little tricks to keep away mice. Using mothballs, or Bounce fabric sheets both work well. Or, if you don't have pets or little kids ( i know, sometimes it's hard to tell the difference ) you can put out a dish of antifreeze.
