There is no way, as a fan of the game in general, you can sit there and honestly say he did nothing wrong at all. The situation was turned into a joke...but it was initiated by a decision that Tom made to not follow the rules. Sorry, but that is a fact. Facts can't be argued.
 
He did nothing wrong at all... or... i should say, it is even more plausible that he did absolutely nothing wrong than it is that there was some massive conspiracy to let half a fcking lb of psi out of footballs.

If anyone is guilty of anything it is the Patriots putting out that ridiculous "Wells Report in Context" crap. They looked like idiots with that. That said, stupidity doesn't equate to guilt
 
yeah...you're really bringing a fresh perspective to things. Was that a copy and paste from earlier? You seem to think the more BS you come up with somehow changes the circumstances and that people on the other side need to update their stance. That's not how it works. We're dealing a history of institutional non-compliance and you play victim when no one wants to give you the benefit of the doubt....then call me pathetic? It's just so ridiculous. You should just own that your team cheats. Take the "you're not trying if you're not cheating road". It fits you guys better anyway...
 
Just last year, there were 5th graders all over the damn place winning science fairs by proving that environmental factors can and will produce exactly what was observed with those footballs.

Translation: just like the district court, they weren't really weighing the substantive merits of the case against Brady, just looking at the procedure the NFL pursued and whether it complied with the CBA. Sounds like it did, despite what New England's crack team of 5th Grade lawyers may have concluded.

I get that, and you're right (about what the judges ruled on) and it sucks.

What I was referring to is the quote that came directly from one of the bunch - according to ESPN.com: "Circuit Judge Denny Chin said evidence of ball-tampering was "compelling, if not overwhelming" and that there was evidence that Brady "knew about it, consented to it, encouraged it."

Yup. Denny Chin, for one, is still dumber than a 5th grader.
 
Also, in case it's escaped anyone else's notice: there is now actual legal precedent that the NFL can request a mobile phone or similar "piece of evidence" and then suspend a player for not turning it over. So much for the (very relatively) small fine guys like Brett Favre got for exactly this.

At oral argument, the Association further contended that the Commissioner was improperly punishing Brady for destroying his cell phone because he was required to institute a new disciplinary action (so that Brady could then appeal any determination that he had destroyed his cell phone). This argument fails because, as set forth in the original disciplinary letter, Brady was punished for failing to cooperate, and it is clear from the Commissioner’s decision that Brady’s cell phone destruction was part and parcel of the broader claim that he had failed to cooperate. Further, as we stated with regard to general awareness, nothing in Article 46 limits the arbitrator’s authority to reexamine the factual basis for a suspension by conducting a hearing. Additionally, the Commissioner did not increase the punishment as a consequence of the destruction of the cell phone—the four‐game suspension was not increased. Rather, the cell phone destruction merely provided further support for the Commissioner’s determination that Brady had failed to cooperate, and served as the basis for an adverse inference as to his participation in the scheme to deflate footballs.

Finally, any reasonable litigant would understand that the destruction of evidence, revealed just days before the start of arbitration proceedings, would be an important issue. It is well established that the law permits a trier of fact to infer that a party who deliberately destroys relevant evidence the party had an obligation to produce did so in order to conceal damaging information from the adjudicator. See, e.g., Residential Funding Corp. v. DeGeorge Fin. Corp., 306 F.3d 99, 106–07 (2d Cir. 2002); Byrnie v. Town of Cromwell, 243 F.3d 93, 107–12 (2d Cir. 2001); Kronisch v. United States, 150 F.3d 112, 126 (2d Cir. 1998). These principles are sufficiently settled that there is no need for any specific mention of them in a collective agreement, and we are confident that their application came as no surprise to Brady or the Association.

Previously, there was no legal precedent saying that any player was obligated to hand over a mobile phone. Sure, a few have refused and received relative slaps on the wrist (relative to being suspended for a quarter of a season). And nobody's challenged that before.

But now, what else does that statement infer other than "a player asked to turn over a privately-owned mobile device to the league or the league's designated investigators is legally obligated to do so"? Sure, a slightly different statement than I started out with, and thanks for helping me to refine my thoughts.

So, I misspoke when I said that there's legal precedent for suspension as a result of not turning over a phone. But how much of a leap is that, really, from the fact that there's now legal precedent stating that players are obligated to turn over phones when asked?
