I just purchased a Wine Expert, Selection, Original Series, Merlot kit. When I bought it yesterday the lady at the LHBS asked if I had a 6g carboy (which I do), but I open and read the instructions and they call for an 8g primary. The bucket I have is your garden variety 6.5g Ale-Pail.

I guess the question is, do I need to go out now and get a larger bucket? or there really enough headroom in the ale-pail?

It should work just fine. Wine kits tend to not foam a whole lot. I use an ale pail, too, for primary. I actually measured mine, though, and it holds 7.5 gallons at the tippy top. You still should have no worries, even if it is a bit small.
 
I used a 6 1/2 gallon carboy for my Winexpert White Zin and it worked fine. It didn't foam like beer does so I'm sure your ale pale will be fine.
