So we are making a lager that says the fermentation temp should be 45-50 F. My brew buddy and I want to put it in the fridge for fermentation but the fridge is not just a fermentation fridge and we have food in it. We are think about putting the temp at 40 which is the upper max per the USDA. Should we just do think or just let it ferment in the apartment which is kept at 71 F?
 
With a fan and some wet towels you can get that 71 down into the 60s. Use the same recipe just substitute the lager yeast with a clean fermenting ale yeast. The result will be much tastier then fermenting at the wrong temp.
 
Another option is to use a Kolsch or Altbier yeast, ferment as cool as possible, then lager in the fridge below 40 after that.

Thats what I would do, fwiw.
