Not sure if this is the right spot to put this. But here goes.

So I just put my eHerms /hlt together and noticed that the return arm of the coil is pretty much touching my element. Will this create any issues with either the element or creating a “hot spot” on my coil?

You will be fine. Where is your thermometer, on the coil return side? That will give you the exit temp of the wort from the hlt, regardless of if there is a hot spot or cool spot. Heck, my coil is too large for my hlt and sometimes half of it sticks above the water in my hlt, that just means the water bath in the hlt needs to be warmer to allow the exit wort to meet the temp desired by my temp sensor. Does that make sense? As long as the wort exiting the hlt coil is the temperature you need it to be, it doesn't matter what individual temps are within the coil itself.
 
No, you're fine. You can tough the element when it's on and you will not die. With all the water around the element and the wort flowing through the coil, there will be no chance of overheating anything.

Sounds good. I have my temp probe in my sparge arm.
