O.P. - how do you know he was drunk? What if it was a medical condition and was stumbling to you for help?

And lethal force would warranted after the vehicle is stopped, and the driver is stumbling around?

In that moment, I don't and it's a valid point. My understanding is that the justification comes from his coming toward me.

Like I said, really glad we don't have to test the theory and I don't have to live with it.
