I won't go into the likelihood of prosecution etc., but to the letter of the law it is.
They have their place. I have no shame in picking up an 18 pack of Coors for drinking while doing work around the house, they are cheap and go great with hot weather and manual labor. Also, I never turn down a beer unless its I have to drive, work or study :D.
