So... I'm sitting in a hotel room, bored, and surfing the web when I get a wild hair and looked to see about the legalities of home brewing. Nice that I have already done a few batches already and just now looked for this info. Imagine my surprise when I notice that home brewing seems to be illegal....unless you apply for a brewers license which is $2500/year. I have found no provisions/exceptions for home brewers. Anyone have some insights? Anything that I am overlooking?
 
It sounds like AL, KY, UT are all illegal, but I have only looked at the statutes for KY (since I live there). I'm sure that it's something that is minimally enforced, but I want to know if anyone has had any problems, or knows of something that I may not.
 
Ive never tried brewing with KY jelly, according to the wikipedia article it has preservatives in it so it might harm the yeast, it also has glycerin which would add some sweetness and body to the brew :D
 
I was rereading my post and noticed that, as well as starting off with "So... I'm sitting in a hotel room....". Yeah, not the best start guess. What if the KY was flavored? Hmmmm..........

How do homebrew shops operate if that is the case? There is also a fairly public homebrew club here in Louisville. I know that none of them have paid $2500 for the pleasure. This can't be right!

Not to mention that I am sipping some Ky brewed homebrew right now. (Damned fine if I do say so myself!)

It looks like a technicality. The home brew shops would be staked out if it was really prosecuteable.
 
My father-in-law has lived in northern Kentucky his whole life and has been making wine for more than half that time. He's always prided himself on flying the straight narrow, a regular Hank Hill he is. I wonder how he'll react when I give him this bad news. :D

KY for beerporn, not for beermaking.
 
What is beerporn without beermaking? I don't understand.

Oh well, If I am Guilty.....Let me pay the price.......*in the mean time I will enjoy another homebrew and forget all about this nasty thread!*
 
Wait wait wait, wouldn't using KY in beer ruin the head? You know, taste a little greasy? I guess it would help it go down really smoothly....
 
All of the home brew shops, suppliers, etc are supplying ingredients... what you do with them is your business. The rules are found here http://www.lrc.ky.gov/krs/titles.htm, look under Title XX Alcoholic Beverages for sections 241.010 (definitions of alcoholic beverages, brewers, etc), 243.020(1) (can't manufacture without license), and 243.040(1) Fees (for the license to brew). It's all BS as there's a statutes that says that any licensee cannot sell alcohol to any person that does not "make proper provisions for his family"(KRS 244.070). I'm thinking of researching a bit more and writing to my local state rep for a change. I would suggest that everyone else do the same. Most states allow for a 100 gallon/household adult/year allowance

Edit: I should say that it is my understanding that most states allow for manufacture of up to 100 gal/adult/yr
 
Technically, homebrew shops don't have any alcoholic beverages in them at all. They have barley, hops, yeast, and various other bric a brac. It's the same theory that head shops can sell bongs under. You don't know what the customer will do with it after the items have been purchased.

I've always wondered if someone underage could actually buy homebrewing supplies. I'm sure store policy would say no, but I mean legally if they could or not. After all, there's no law against buying grain is there? :D
