Most simply, homebrew is "home" brew and can not be sold at all. An ATF agent once told me that strictly speaking it shouldn't even be taken from the home. So if you want to make money selling beer you have to have a licensed, commercial set-up.

I once read that in a couple of states people were permitted to sell their homebrew at local Farmer's Markets. I think Vermont was one of the states. It could have been all BS for all I know.
