DO they need to be cooked or not?

In "how to brew" Palmer says flaked oats have already been prepped and do NOT need to be cooked.

In my clone brew book though the recipe calls for cooking the "flaked oats"

I am confused...

Flaked oats do not need to be cooked before you use them. You can simply put them into your mash or into a steeping bag with the rest of your steeping grains.

If you buy whole oats you will need to cook them first (basically make oatmeal) to gelantinize the starches.

I would recommend processing them first in a food processor. I found I get an extra couple of gravity points in my porter recipe when I do that. It makes the starch more readily accessible for the enzymes.

If you want a slightly nutty flavor, toast them on a baking sheet in the oven @ 350oF for ~30 mins. I do it for most of my beers using oatmeal.
