Legal or not that is definitely low. They are identical. Keep fighting the fight Forrest. Don't let these slime balls get you down. It's only a matter of time before they steal the wrong image and lose everything in a legal battle.

You need to defend your copyright. Send them a CaD. If you don't, you won't have grounds to defend the next one that comes along. They're not making derivative works, they're lifting artwork directly and that's not cool (this is a legal term (no it's not)).

I hadn't seen your design before, but I love it. Next time I go on a T-shirt ordering binge, It's on my list. . . from your site. . . legitimately.

Bottling the Belgian: A Photo Odyssey

Beer is the mind-killer. Beer is the little death that brings total obliteration. I will face my beer. I will permit it to pass over me and through me. And when it has gone past I will turn the inner eye to see it's path. When the beer has gone there will be nothing. Only I will remain.

Oh enough with the "you just used AC/DC's design" horsecrap. AHS has been selling that design from day one with the OG/FG configuration. It's a tribute to beer and rock and is fair damn game.

I just sent them nasty emails.

It was wrong for them to lift the artwork and you should send a CaD but Irregular is also correct that AC/DC can most definitely do the same for using the likeness of their logo. They probably have much bigger fish to fry with blatant reproduction of the actual logo. Open source is only open if the creator of the work deems is open.

There is no way AC/DC can sue for that because the new logo would fall under fair use doctrine.

Quote:
The 1961 Report of the Register of Copyrights on the General Revision of the U.S. Copyright Law cites examples of activities that courts have regarded as fair use: “quotation of excerpts in a review or criticism for purposes of illustration or comment; quotation of short passages in a scholarly or technical work, for illustration or clarification of the author’s observations; use in a parody of some of the content of the work parodied; summary of an address or article, with brief quotations, in a news report; reproduction by a library of a portion of a work to replace part of a damaged copy; reproduction by a teacher or student of a small part of a work to illustrate a lesson; reproduction of a work in legislative or judicial proceedings or reports; incidental and fortuitous reproduction, in a newsreel or broadcast, of a work located in the scene of an event being reported.”

I dont believe they did anything to obscure the name/web address. That would have required effort on their part. It appears like they just took the small image and pasted it onto a generic tshirt pic. (the blured our perception would be from blowing it up)

Not much you can do as you will lose more money from lawyers than you would gain from tshirt sales.

I doubt they are paying anything to the achorman movie crew either..

With shipping, their shirt is $1 cheaper than yours. Thanks for the link! I love saving money.
